01Introduction and Acceptance
These Terms and Conditions ("Terms") govern the services provided by RT Tutoring, LLC, doing business as More Than A Teacher ("we," "us," or "our"). By enrolling in or using our services, whether you are the student or the parent or guardian enrolling on a student's behalf ("you" or the "client"), you agree to these Terms. If you do not agree, please do not enroll in or use our services.
02Services and Scope
We provide test preparation and academic tutoring services as described on our website and in your enrollment, delivered in person and/or online. The specific services, schedules, and pricing applicable to you are those described on our website or quoted to you at the time of enrollment. We help students improve test scores and academic skills; we do not guarantee admission to any school, college, university, or program.
03The Guarantee
Certain of our standard classes include a score-improvement guarantee. The full terms of that guarantee, including eligibility, how a student's baseline score is established, the conditions a student must meet, and how refunds are calculated, are described on our Guarantee page and are incorporated into these Terms by reference. Some short-format or partner-school programs are not eligible, as noted for those programs. To ask about or claim the guarantee, contact us at questions@dfwtestprep.com.
04Enrollment and Payment
To enroll, you must be at least 18 years of age and the student or the student's parent or legal guardian. You agree to pay the fees for the services you enroll in, at the prices quoted to you at the time of enrollment. Payment is due in full at the time of enrollment unless we have agreed with you in writing to different payment terms. We accept the payment methods indicated during enrollment. If a payment fails, is reversed, or is charged back, we may suspend or cancel the affected services until payment is resolved.
05Cancellation, Rescheduling, Refunds, and No-Shows
If you need to cancel or reschedule a session, we ask for at least one business day's notice. Sessions cancelled or rescheduled with less notice, and sessions a student does not attend without notice ("no-shows"), may be charged in full or forfeited. We may, at our discretion, waive a charge or offer a make-up session in individual cases; doing so does not obligate us to do so on any other occasion.
Except where the Guarantee applies, fees are generally non-refundable once services have begun or been used. We may consider refund or credit requests on a case-by-case basis at our discretion. Fees for services not yet begun may be refunded at our discretion.
06Parents and Guardians; Students Under 18
Many of our students are under 18. If you enroll a student who is a minor, you confirm that you are the student's parent or legal guardian, or are otherwise authorized to enroll the student and agree to these Terms on the student's behalf. As the enrolling adult, you are responsible for payment, for the student's compliance with these Terms, and for arranging the student's attendance and, where sessions are in person, transportation and pick-up. You consent to the student's participation in our services, including online sessions where applicable. Our handling of personal information, including student information, is described in our Privacy Policy.
07Student Conduct
We expect students to behave respectfully toward instructors, staff, and other students, and to participate constructively in sessions. We may remove a student from a session, class, or program for disruptive, abusive, or unsafe behavior. No refund is owed where a student is removed for such conduct.
08Intellectual Property
All materials we provide, including practice tests, worksheets, guides, class content, and articles and resources on our website, are our property or used with permission, and are protected by copyright and other laws. We grant you a limited, personal, non-transferable license to use the materials for the student's own preparation and learning. You may not copy, share, sell, publish, distribute, or reuse our materials, including incorporating them into your own or another party's materials, without our written permission.
09Disclaimers and Limitation of Liability
We provide our services with reasonable care and skill. Results vary from student to student, and except for the specific score-improvement guarantee described on our Guarantee page, we do not warrant or guarantee any particular score, grade, or academic outcome.
Articles, guides, and other resources on our website and in our Learning Center are provided for general informational purposes only. They may not be current, complete, or accurate in every case, as test dates, formats, policies, and requirements change. You should not rely on them as the sole basis for any decision, and you should confirm important information with official sources such as the College Board and ACT.
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to our services or these Terms will not exceed the amount you paid us for the services giving rise to the claim, and we will not be liable for any indirect, incidental, or consequential damages. Nothing in these Terms limits or excludes any liability or right that cannot be limited or excluded under applicable law, including under the Texas Deceptive Trade Practices-Consumer Protection Act.
10Indemnification
You agree to indemnify and hold us harmless from any losses, claims, or expenses arising from your or the student's breach of these Terms or misuse of our services.
11Trademarks
SAT and PSAT/NMSQT are trademarks of the College Board. ACT is a trademark of ACT, Inc. ISEE is a trademark of the Educational Records Bureau (ERB) or its successors. None of these organizations sponsors or endorses us or our services. All other trademarks are the property of their respective owners.
12Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or our services will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction of those courts. In these Terms, "business day" means a day other than a Saturday, Sunday, or federal or Texas state holiday.
13Changes to These Terms
We may update these Terms from time to time. Changes take effect when we post the updated Terms on our website, and the "last updated" date above indicates when they were most recently revised.
